By purchasing or holding a ticket (“Ticket”) to the Jamaica Music & Food Festival (“Festival”), you (“Ticket Holder,” “you,” or “attendee”) agree to be bound by these Terms & Conditions (“T&Cs”).
1. License & Entry
1.1. A Ticket grants you a revocable license to attend the Festival at the date, time, and location specified.
1.2. The festival organizer (“Organizer,” “we,” “us,” “our”) reserves the right to refuse admission or revoke your license at any time, without refund, for any reason including misconduct or breach of these T&Cs.
1.3. Tickets are non-transferable, unless otherwise permitted in writing by the Organizer, and must not be resold or used for commercial purposes without prior approval.
2. Ticket Purchase & Verification
2.1. Tickets must be purchased from authorized sources only. Tickets obtained through unauthorized sellers may be voided without compensation.
2.2. You must present a valid Ticket and government-issued photo ID (or other identification as required) at entry.
2.3. Lost, stolen, or damaged Tickets will not be replaced and the Organizer bears no responsibility for such losses.
3. Refunds, Cancellations & Postponement
3.1. All sales final: Unless otherwise stated, Ticket purchases are final and non-refundable for change of mind, inclement weather, or minor changes to lineup or schedule.
3.2. Event cancellation: If the Festival is canceled in full and not rescheduled, Ticket Holders are entitled to a refund of the face value of the Ticket (not including booking fees, service charges, or third-party expenses) within a timeframe to be announced by the Organizer.
3.3. Event postponement / rescheduling: If the Festival is rescheduled, your Ticket will be valid for the new date. If you cannot attend on that new date, you may request a refund of the face value (excluding fees) within the timeline announced by the Organizer.
3.4. Material change: The Organizer does not guarantee any specific artist lineup; withdrawals or substitutions of artists do not constitute a “material change” entitling a refund. Minor schedule or stage change also do not qualify for refunds.
3.5. In all cases, refunds will be paid through the original payment method, unless otherwise determined by the Organizer.
4. Force Majeure & Unforeseen Circumstances
4.1. The Organizer shall not be liable for any failure or delay in performance due to circumstances outside its reasonable control (e.g. natural disaster, extreme weather, government order, health emergencies, terrorism).
4.2. In the event of force majeure, the Organizer may cancel, postpone, or modify the Festival at its discretion.
4.3. If the Festival is canceled or modified due to force majeure, the Organizer will determine whether refunds, credits, or other remedies will be offered and the manner of such distribution.
5. Behavior, Safety & Venue Rules
5.1. The Ticket Holder agrees to comply with all venue rules, security protocols, health and safety guidelines, and instructions from staff.
5.2. Weapons, illegal substances, outside food or drinks, professional cameras, or disruptive items (as defined by the Organizer) may be prohibited.
5.3. The Organizer reserves the right to remove or eject Ticket Holders engaging in dangerous or prohibited conduct, without refund.
5.4. You attend at your own risk. The Organizer is not liable for personal injury, loss, or damage to personal property unless caused by the Organizer’s gross negligence.
6. Age & Access Restrictions
6.1. Attendees below a specified minimum age (e.g. 18 years) must be accompanied by an adult, unless stated otherwise.
6.2. Certain areas (VIP, backstage, etc.) may have restricted access; entry to those areas requires appropriate credentials or passes.
7. Media & Publicity
7.1. By attending, you grant the Organizer and its partners the irrevocable right to photograph, film, and record you in connection with the Festival and to use your likeness in promotional materials without compensation.
7.2. You waive any right to inspect or approve the finished product.
8. Intellectual Property & Use of Ticket
8.1. All content and materials made available at the Festival (e.g. branding, programs, music) remain the intellectual property of the Organizer or respective rights-holders.
8.2. You may not reproduce, distribute, or commercially exploit Festival materials or your Ticket (e.g. reprinting, copying, resale) without prior permission.
9. Limitation of Liability & Indemnity
9.1. The Organizer’s liability to you is limited to the face value of your Ticket.
9.2. Except where prohibited by law, the Organizer will not be liable for indirect, incidental, consequential, or special damages.
9.3. You agree to indemnify and hold harmless the Organizer, its agents, affiliates, and staff from any claims, damages, or costs arising from your breach of these T&Cs or your conduct at the Festival.
10. Privacy & Data
10.1. Personal information collected during ticket purchase or at entry (name, contact info, ID, etc.) will be used in accordance with the Festival’s Privacy Policy.
10.2. You consent to receive communications regarding the Festival (updates, changes, promotions) unless you opt out.
11. Governing Law & Dispute Resolution
11.1. These T&Cs are governed by the laws of the jurisdiction in which the Festival is held.
11.2. Any disputes will be resolved through negotiation first, then arbitration or courts of competent jurisdiction if necessary.
11.3. If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.
12. Amendments
The Organizer reserves the right to amend these T&Cs at any time. The version posted on the Festival website (or ticketing platform) at the time of your purchase is the final binding version.
